Scope
Fios was engaged to perform a comprehensive Open Data Intelligence review, including an analysis of professional history, adverse listings, social media activity, politically exposed person (PEP) status, and potential involvement in anti-money laundering (AML), bribery, civil or criminal litigation, and broader compliance issues.
The scope included in-depth screening and profiling, negative media coverage checks, sanctions, and watchlists, and any existing regulatory or reputation concerns.
Process
Fios’ proprietary automation tool conducted real-time scans of relevant Open Data sources, including multiple global sanctions lists, watchlists, and domestic regulatory databases. This advanced technology systematically collated critical, high-value information from hundreds of authoritative and trusted public sources, (and their sub-databases), enabling comprehensive, adaptive, and dynamic compliance checks that provided timely, accurate, and up-to-date results for effective risk mitigation and regulatory oversight.
Findings
Adverse Media
Fios identified significant adverse media involving the Target entity and its principal, including criminal charges for alleged fraud (2012), a regulatory penalty from a State RERA for unregistered real estate advertising, litigation over a trust appointment due to alleged fund mismanagement (2017), and office sealing by revenue authorities for unpaid dues (2017). These events reflected ongoing regulatory and legal risk exposure.
Litigation and Political Exposure
The Target has been involved in multiple unresolved and disposed cases, including pending matters, in the Supreme Court, Bombay High Court, and Thane District Courts related to property and injunction disputes.
Additionally, a key member of the Target entity has prior political leadership roles, is a former state election candidate, and appeared on the MCA’s ‘Defaulters List,’ underscoring elevated litigation risk and political exposure.
Outcome
Upon reviewing the Fios open data report, the client restructured the deal, due to the identified compliance lapses and reputation risk.
